This, my friends, is very, very good news, as it stands for the rule of law, and not of men.

King Obama's "recess" appointments to the NLRB have been declared unconstitutional.  In a UNANIMOUS DECISION!!

"[T]he President made his three appointments to the Board on January 4, 2012, after Congress began a new session on January 3 and while that new session continued," the court wrote in its decision. "Considering the text, history, and structure of the Constitution, these appointments were invalid from their inception."

Recall that these appointments occurred when the Congress was in a sort of pro forma session, to prevent just this sort of recess appointment, because the King couldn't get his choices approved through the normal process because they were all such hacks, and he refused to nominate any that could.  The disrespect for the Constitution, Congress, and the rule of law displayed by this action was breathtaking, although naturally the Main Stream Media was mostly in favor.

At least until King Obama can pack the court with more of his "living constitution" thugs, savor this decision.  It means our self appointed master cannot get his petulant way whenever he wants.

It's just unfortunate that a lawsuit had to be filed, and processed, before this was decided.   It should have been obvious from the start.

Clarification: This is a three judge decision from a District Court of Appeals.  The bad guys can still appeal to the Supremes, and probably will, but with little chance of success given the unanimous nature of the decision (and the original action's obvious lawlessness).
